Will of Samuel Edwards

Pettis County, Missouri
January 16, 1857

In the name of God Amen. I Samuel Edwards of the County of Pettis, State of Missouri being of sound mind & memory and considering the uncertainty of this frail and transitory life do therefore make, ordain, publish and declare this to be my last Will and Testament that is to say.

First. After all my lawful debts are paid and discharged. The residue of my estate real & personal I give, bequeath and dispose of as follows to wit: To my son Henry D Edwards I bequeath the sum of one dollar. To Mary A Fisher my daughter one dollar and to Elizabeth J McDaniel one dollar. Minerva R Roberts I bequeath one dollar and to Frances B George I bequeath one dollar and to Eliza C Bales I also bequeath one dollar, and Sarah M Edwards I bequeath the sum of three hundred dollars out of my estate. All of the above named persons are my bodily heirs and I also bequeath my beloved wife Lucy as a special legacy - the sum of four hundred dollars out of my estate and retain unto her the special right of remaining in the full possession of the real estate owned by me at this time or she may consent for the same to be sold and the claims of the legatees discharged at any time. The above privileges is hereby granted to my beloved wife during her natural life or widowhood. And I bequeath to my son John W Edwards after the discharge of the aforementioned claims all of my property both real and personal of every variety and grade. To have and behold forever.

Likewise I make, constitute & appoint Alonzo J Edwards to be Executor of this my last will and Testament hereby revoking all former wills by me heretofore made.

In Witness Whereof I have hereunto subscribe my name and affix my seal this the 16th day of January in the year of our Lord one thousand eight hundred and fifty seven.

The above written instrument was subscribed by Samuel Edwards in the presence and acknowledged by him to each of us and he at the same time published and declared the above instrument so subscribed to be his last will & testament and we at the Testators request and in his presence have signed our names as Witnesses hereto and written opposite our names and respective places of residence.

I, R R Spedden, Clerk of the County Court of the County of Pettis do certify that on the 22nd that the foregoing instrument purported to be the last Will and Testament of Samuel Edwards dec'd was presented in court for probate and proven by the oaths of Alonzo J Edwards & Daniel A Gardner, the two subscribing witnesses thereto to have been acknowledged and published by the decedent as his Last Will and Testament that they subscribed thereto as witnesses in his presence at his request and in the presence of each other, and at the time of so making and publishing the same they believed him to be of sound mind & disposing memory whereupon the same was ordered to record & is together with this certificate truly recorded in my office.
