In the name of God Amen. I, John Rowntree of the town of Brownville Edmondson County and State of Kentucky being in good health & of sound mind and memory, but calling to mind the uncertainty of life, and the near approach of Death and desiring to make a specific disposition of what worldly goods it has pleased the almighty to bless me with, do ordain and declair this to be my last will and testament hereby revoking all other or former wills as divised heretofore by me in anywise made.

First I commend my soul to God who gave it and my body to the mother dust to be buried in a decent Christian manner after which I will that my just debts and burial expenses be paid.

2nd, Having heretofore advanced to my children Hiram, Jesse C, John H and Rutherford H Roundtree, Lucintha M Kinsey, Synthia Ann Crump Roberson Henry & Lucy A Rogers what I designed to give them I will and declair that the said advancements to them severally is all that I design to have out of my estate.

3rd It is my will and desire that all of the property both real and personal of whatsoever kind, both in Kentucky and elsewhere, of which I may die seized & possessed, vest in and decend to my daughter Benroyal H Rowntree out of which she the said Benroyal H is to support her mother Rebecca Rowntree during her life. The desire hereby made to my daughter is more than an equal proportion with the advances made to my other children, but I make the distinction in consequence of the extraordinary attention & trouble bestowed by her on her mother during her affliction for the last three years, the tenderness what which she has treated her parents in their old age.

4th I hereby nominate, constitute & appoint my said daughter Benroyal H Rowntree sole executrix of this my last will and Testament, and desire and direct that the court permit her to execute the same without entering into any Bond with security as required by law.

In testimony whereof I have hereunto set my name and affixed my seal this 15th day of September in the year of our Lord Eighteen Hundred and thirty six.

Witness: A M Barrett, R Mitchell, John D Otten, Nancy R Vertriss, George Heardt, T E Staples - witnessed by us the 22nd day of March 1853.

Pettis County Court June 6, 1853. Now at this day comes here unto Court A M Barrett and Benroyal H Barrett and present to the court here the last will and testament of John Rowntree, deceased, and therefore come George Heard and Thomas E Staples, two of the subscribing witnesses thereto who after being duly sworn state that they signed their names as witnesses thereto in presence of Testator, and of each other and that the said Testator acknowledged the said Instrument of writing to be his last will & Testament, on the day of their attestation thereto it being the 22nd day of March 1853 and that they believe that the said Testator was of sound mind. Therefore the Court admitted the said will to record.
